1. Agreement to Terms

By accessing or using CMSFusion ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services. These terms apply to all visitors, users, and others who access or use the Platform.

2. Products & Marketplace

CMSFusion is a marketplace for premium CMS products, themes, plugins, and digital assets. We provide a platform where customers can browse, purchase, and download high-quality CMS products for use in personal and commercial projects.

3. Purchases & Payments

• All purchases are one-time, non-recurring payments unless otherwise stated.
• Prices are listed in US Dollars (USD) and are subject to change without notice.
• Payments are processed securely via Authorize.Net. We do not store your card details.
• Upon successful payment, you receive a license key and perpetual access to download the purchased product.
• All sales are final. Refunds are issued at our discretion in cases of significant defects or technical issues.

4. Licensing

When you purchase a product from CMSFusion, you receive:

• A personal or commercial use license for use on a single website or project.
• A unique license key tied to your account for activation and verification.
• Lifetime access to the downloaded product files (as they existed at the time of purchase).
• The right to modify the product for your own use.

You may not:

• Redistribute, resell, or share purchased products with third parties.
• Claim ownership or authorship of any purchased product.
• Use purchased products in items intended for redistribution (e.g., product bundles, template marketplaces).
• Share or publish your license key publicly.

5. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to terminate accounts that violate these terms.

6. Downloads

Purchased product files are available for download from your account dashboard at any time. We make reasonable efforts to ensure file availability, but we do not guarantee uninterrupted access. It is your responsibility to keep local backups of purchased files.

7. Refund Policy

Due to the digital nature of our products, all sales are generally final. However, we may issue refunds in the following cases:

• The product has a significant defect that renders it unusable and cannot be resolved.
• You were charged multiple times for the same product due to a technical error.
• The product description was materially misleading.

Refund requests must be submitted within 14 days of purchase by contacting our support team.

8. Intellectual Property

All products, logos, content, and materials on CMSFusion are protected by intellectual property laws. The CMSFusion brand, name, and platform design are our exclusive property. Purchasing a product grants you a license to use the product, not ownership of the intellectual property.

9. Disclaimer of Warranties

Products are provided "as is" without warranty of any kind, express or implied. We do not warrant that products will meet your specific requirements, be error-free, or be compatible with all hosting environments or CMS versions.

10. Limitation of Liability

To the fullest extent permitted by law, CMSFusion shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform or any purchased products, even if advised of the possibility of such damages.

11. Changes to Terms

We may update these Terms of Service at any time. Continued use of the Platform after changes are posted constitutes your acceptance of the revised terms. We will indicate the date of the most recent update at the top of this page.
